These terms govern your use of buildingcapture.com (the "Site"), operated by Chronicle Holdings LLC, doing business as Building Capture ("Building Capture," "we," "us," or "our"). By using the Site, you agree to these terms. If you don't agree, please don't use the Site.

1. WHO WE ARE

Building Capture is a building documentation company based in southwest Michigan, serving commercial and industrial clients. Our services include drone photography and video, aerial mapping, drone LiDAR surveying, thermal inspections, facade inspections, 3D laser scanning and scan-to-BIM, as-built floor plans,virtual tours, and building photography.

2. USE OF THE SITE

You agree to use the Site only for lawful purposes. You won't:

• Attempt to gain unauthorized access to the Site or any related systems

• Interfere with or disrupt the Site's operation

• Copy, scrape, or reproduce Site content beyond normal browsing, without our permission

• Use the Site to submit false, misleading, or fraudulent information

3. QUOTE REQUESTS AND INQUIRIES

Submitting a quote request, contact form, or other inquiry through the Site does not create a contract between you and Building Capture. Pricing is not published on the Site and any figures discussed informally are not binding. A project is only confirmed once we've agreed on scope and price in writing, typicallythrough a written quote, proposal, or signed service agreement.

4. SERVICES AND SERVICE AGREEMENTS

Content on the Site describing our services is for general informational purposes. It doesn't guarantee availability, specific outcomes, or that a given service is right for your project. Once we take on a project, the specific scope, deliverables, pricing, payment terms, timeline, and ownership of deliverables are governed by the written agreement for that project (typically a Master Service Agreement or written quote), not by these terms.

Thermal inspections, LiDAR surveys, and similar diagnostic services identify conditions warranting further investigation. They are not a substitute for a licensed professional inspection, engineering evaluation, or code compliance review, and shouldn't be treated as one.

5. DRONE OPERATIONS

Our drone flights are conducted under FAA Part 107 by certified pilots. When you engage us for a project, you're responsible for confirming you have the authority to permit a drone flight over the property in question, and for flagging any airspace restrictions, site hazards, or access issues you're aware of. We'll handle standard airspace authorization as part of normal project planning.

6. INTELLECTUAL PROPERTY

The Site, including its text, photos, video, graphics, and logos, is owned by Building Capture or used with permission, and is protected by copyright and other intellectual property laws. You may view and share Site content for normal, non-commercial purposes, but may not otherwise copy, modify, distribute, or use it commercially without our written permission.

Ownership of photos, video, scans, and other deliverables produced for a specific client project is addressed in that project's service agreement. Unless that agreement says otherwise, Building Capture retains ownership of the underlying photos and files.

7. NO WARRANTY

The Site is provided "as is" without warranties of any kind, express or implied. We don't guarantee the Site will be uninterrupted, error-free, or that all information on it is complete or current. Where we describe past projects, capabilities, or response times, these reflect our general practice and are not a guarantee for any specific project.

8. LIMITATION OF LIABILITY

To the extent permitted by law, Building Capture is not liable for any indirect, incidental, or consequential damages arising from your use of the Site. This section doesn't limit liability that arises under a separate signed service agreement for an actual project, which is governed by the terms of that agreement.

9. THIRD-PARTY LINKS AND SERVICES

The Site may link to or use third-party services, such as our website hosting platform or scheduling tools. We aren't responsible for the content, functionality, or practices of third-party services.

10. INDEMNIFICATION

You agree to hold Building Capture harmless from any claims, damages, or expenses arising from your misuse of the Site or violation of these terms.

11. GOVERNING LAW

These terms are governed by the laws of the State of Michigan, without regard to conflict of law principles. Any disputes will be handled in the state or federal courts located in Michigan.

12. CHANGES TO THESE TERMS

We may update these terms from time to time. The effective date at the top will reflect the most recent revision. Continued use of the Site after a change means you accept the updated terms.
